General Conditions of Sale

General conditions of sale (CGV) for online purchases on the website www.g-inglese.com .

G. Inglese S.r.l.s. with registered office in Piazza Marconi 22 in Ginosa (TA), Italy, CF/P.IVA 03019800733, phone/fax (+39) 099 829.25.72, invites users to read these GCS which regulate the purchase of products and the management of orders placed on the site.

1. Acceptance of the General Conditions of Sale and conclusion of the contract

The contract stipulated between G. Inglese Srls (hereinafter G. Inglese) and the Customer (i.e. the subject, natural person, who makes the purchase on the site, not referable to his commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even if only partial, of the order by G. Inglese. In the event of non-acceptance, G. Inglese will, in any case, promptly notify the Customer.

By placing an order in the various ways provided, according to the order form on the site, the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept these GCS.

These GCS can be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

2. Order and Order Confirmations

The products offered for sale by G. Inglese are only those present on the site at the time the order is forwarded, as described in the relative information sheets.

In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but may differ, for example, in color and size (also due to the browser and monitor used to access the site and view images).

To place an order, the Customer must fill out the relative form on the site in its entirety and send it after having carefully read the GCS, as well as the characteristics of the product or products he intends to purchase. The Customer must also ask G. Inglese, if he wishes, to issue a tax invoice, relating to the purchase, pursuant to art. 22 of Presidential Decree 633/1972.

The correct receipt of the order is confirmed by G. Inglese with a response via e-mail sent to the e-mail address communicated by the Customer. This confirmation message will summarize the purchase conditions, as required by current legislation, as well as the data entered in the order by the Customer, so that he can verify them and, if necessary, communicate the necessary corrections without delay.

3. Prices and payment methods

The prices indicated on the site are to be considered inclusive of VAT. Any shipping costs or payment costs are, in any case, communicated in advance to the Customer through the site or these GCS.

The following payment methods are foreseen:

  • Paypal

For payment, the Customer can use the Paypal circuit according to the specific methods of the same.

  • Credit card

In cases of purchase of goods with credit card payment methods, the transaction can take place through the secure server Paypal or another secure server chosen by G. Inglese. In no case and at any stage of the payment will G. Inglese be able to know the information relating to the Customer’s Credit Card, transmitted via secure connection directly to the website of the bank which manages the transaction. No computer archive of G. Inglese will keep such data and, therefore, in no case G. Inglese can be held responsible for any fraudulent or illegal use of credit cards by third parties at the time of payment.

  • Wire transfer

In case of purchase by bank transfer, the bank coordinates for payment will be displayed. Payment by bank transfer involves an additional cost of Euro 5.00 to be paid by the Customer. The processing of the order will only start upon effective receipt of the payment in the bank.

G. Inglese reserves the right to ask the Customer for additional documents proving ownership of the credit card. In the absence of sending the documentation, the seller reserves the right not to accept the order. Transaction security is guaranteed by a data encryption system (SLL) and by direct, protected and certified connections.

4. Delivery of products and relative expenses

The purchased products will be shipped to the address indicated by the Customer in the order within, maximum, 4 weeks from G. Inglese’s acceptance of the order, at the cost specifically indicated on the site before sending the order. G. Inglese reserves the right to accept or refuse shipments requested outside the Italian or European borders.

The cost of shipping depends on the country of destination and the weight/volume of the package.

With regard to shipments requested to countries outside the European Union, any import customs fees will be charged to the recipient. Therefore, the Customer is invited to contact the customs authorities of his country in advance to check the costs and any import limits.

In the case of deliveries made to receptions (with the receptionist’s signature for collection), G. Inglese will not be held responsible for subsequent non-delivery of the package to the final recipient.

The shipping times indicated by G. Inglese must be considered as purely indicative and a delay with respect to them, or any shipment made in a fractional manner, does not entitle the Customer to refuse delivery and to request compensation or compensation.

Upon delivery of the products, the Customer is required to check:

  • that the number of packages delivered corresponds to what is indicated in the transport document:
  • that the packaging is intact, not damaged or wet or, in any case, altered even in the sealing materials (adhesive tape or metal strapping).

Any damage to the packaging and/or the product or the mismatch in the number of packages or indications must be immediately detected, placing a specific indication on the transport document to be returned to the courier.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the procedures set out in this document.

5. Right of withdrawal

Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the GCS and, therefore, from the purchase contract for any reason, without the need to give reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

To exercise the right of withdrawal referred to in the previous paragraph, the Customer must send G. Inglese a communication to this effect, within the indicated terms, to the following e-mail address info@g Inglese.it, or use the appropriate form present on the site.

In the event of withdrawal, the Customer must return the products to G. Inglese at his own expense within 14 (fourteen) days of the withdrawal, to the following address:

The goods must be returned intact, complete in all its parts and in the original packaging (envelopes and boxes), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without are signs of wear or dirt, in compliance with the following conditions:

  • the right of withdrawal may apply to the product purchased in its entirety. In fact, it is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, complements, etc.);
  • for the withdrawal to be possible, the product must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, tags, seals, etc.);
  • the shipping costs (and any customs charges, if any) for the return of the goods will be the sole responsibility of the Customer;
  • the shipment, until the certificate of receipt in the warehouse indicated by G. Inglese, is under the complete responsibility of the Customer;
  • in the event of damage to the goods during transport, G. Inglese will notify the Customer, to allow him to promptly file a complaint against the courier of his choice and obtain the relative refund. The product will therefore be made available to the Customer at the same time as canceling the request for withdrawal;
  • Inglese will not be liable in any way for damage, theft, loss occurring during or, in any case, depending on the return shipment.
  1. Inglese will reimburse the Customer for the full amount already paid, within 14 (fourteen) days of withdrawal, by reversing the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not incur any costs as a result of said reimbursement. G. Inglese may suspend the refund until receipt of the returned product or until the moment in which the Customer demonstrates that he has correctly sent back the product, whichever comes first.

In any case, the Customer will lose the right of withdrawal in cases where G. Inglese ascertains that:

  • the returned product and/or its accessories and/or its packaging are not intact;
  • the product is missing its external packaging and/or the original internal packaging;
  • the product is missing integral elements and/or accessories (e.g. closures, laces, buckles, etc.).

In the event of forfeiture of the right of withdrawal, G. Inglese will return the purchased product to the Customer, charging the same for the shipping costs and, if already reimbursed, the price of the product.

6. Warranty

All products sold by G. Inglese are covered by a 24 (twenty-four) month guarantee for lack of conformity, pursuant to Title III of Legislative Decree 206/2005. To use the warranty assistance, the Customer must keep the invoice, i.e. the payment receipt together with the transport document.

The guarantee for lack of conformity will apply provided that the relative product has been used correctly, in compliance with its intended use and with the provisions of the instructions for use and washing present in and/or with the product.

In the event that, for any reason, G. Inglese is unable to return a product under warranty to the Customer (repaired or replaced), or where the repair or replacement is, also due to the value of the product, excessively onerous, G. Inglese will be able to proceed with the appropriate reduction of the price paid, or rather the refund of the entire amount paid with termination of the contract.

In cases where the application of the guarantees provides for the return of the product, the same must be returned by the Customer in the original packaging, complete with all its parts (including packaging and any documentation and accessory equipment).

8. Privacy

The personal data collected with the forwarding of the order will be processed by G. Inglese for the sole purpose of satisfying the express requests of the Customer, in compliance with Legislative Decree 196/2003 and the privacy information on the site. Any further treatments will be carried out only with the express consent of the customer.

By accepting the conditions of sale, G. Inglese will use the personal data of the clients pursuant to the GDPR for logistical and fiscal purposes only. Read the complete information .

9. Applicable law

The sales contract referred to in these GCS and its execution is governed by Italian law, with the disapplication of conflict rules and the United Nations Convention for the International Sale of Goods. The Court of Taranto will be competent for the solution of the relative disputes.

10. Copyright

Trademarks, logos and other distinctive signs on the site belong to their respective owners. The use of trademarks, logos and other distinctive signs including reproduction on other websites by unauthorized third parties is prohibited. The contents of the site are protected by copyright (texts, images and graphics).

11. Agreement

The contract replaces all previous contracts, agreements and understandings between the parties and constitutes the entire agreement between the parties regarding the subject of the contract, together with the order, the general conditions relating to the use of the site and the conditions relating to the registration service. Any variation or modification of the contract must be accepted in writing by both parties.

12. Communications

All communications between the parties must be made in writing and sent to the address of the other party, indicated in the contract and in the order. Communications sent to the e-mail address of the other party, indicated on the site and on the order, are also intended to be sent in writing.

Communications relating to the validity or existence of this agreement must only be delivered by hand or sent by registered letter with acknowledgment of receipt.
